Dear Neighbors,
It's time...we need everyone to help with this. CEMEX has been issued another official Notice of Violation and shortly after that, there was a coal fire at the plant (see www.stvrainwatchdogs.org for the pictures). The Watchdogs have also asked County Commissioner Ben Pearlman if Graham Billingsley, Boulder County Land Use Director,has secretly agreed to permit a Cemex Transfer Station. This could mean a permitted increase of up to 10% annual product volume with consequent yearly potential increase of 4000 truck trips and an undetermined increase in the number of train trips. Finally, within the last few weeks, neighbors have reported alarming noise pollution, and more dust plumes.
Concerned neighbors have resolved that it is time to march and demonstrate to publicize this pay and pollute strategy and call CEMEX into compliance with its operating permit.

We have officially requested the following from the Boulder County Health Department (i.e. Jeff Zayach and Pam Milmoe):
"...In light of the incident of an open coal fire today, the Watchogs request that the Health Department consider action under Colorado's statue at 25-7-112 and 25-7-113 that provides authority to conduct an investigation and issue a Cease and Desist Order in situations where there is either a "clear, present and immediate danger to the environment or the health of the public," or when "such activity or discharge... is of such a nature to cause extreme discomfort or that it is an immediate danger to the welfare of the public because such pollutants make habitation of residences or the conduct of businesses subjected to the pollutants extremely unhealthy or disruptive..."
